Summary

The European Commission proposed a new pact on asylum and migration in September 2020, including a regulation dealing with crisis and force majeure in migration and asylum. The proposal aimed to establish a mechanism for dealing with mass influxes and irregular arrivals of third-country nationals in a Member State. The European Parliament and Council negotiators reached a provisional agreement on the proposal in December 2023, and the Crisis and Force Majeure Regulation was published in the Official Journal on May 22, 2024, to apply from July 1, 2026. The regulation sets out a solidarity mechanism procedure, allowing derogations from the Asylum and Migration Management Regulation, and concerns crisis situations, including asylum crisis management, return crisis management, and registration of international protection applications.
