The Estonian Minister of Social Affairs, Tanel Kiik, is asked to assess whether the conditions for distributing food aid, as confirmed by the minister's directive, are in line with the constitutional requirement of equal treatment of people in similar situations. The conditions in question allow only those who received or applied for subsistence benefits or received support from the local government budget in January, February, August, or September to receive food aid, leaving out those who received or applied for such benefits in other months. The assessment finds that there is no reasonable and relevant reason for this differential treatment, and that administrative and technical difficulties or financial constraints cannot justify unequal treatment. The assessment suggests that the minister find a way to organize food aid that treats people in similar situations equally.
