Summary

The U.S. Environmental Protection Agency (EPA) is writing to clarify misconceptions about its Temporary Policy on COVID-19 Implications for EPA's Enforcement and Compliance Assurance Program. The policy, created in response to inquiries from states and the regulated community, allows the EPA to prioritize resources to respond to acute risks and imminent threats, rather than making case-by-case determinations regarding routine monitoring and reporting. The EPA continues to enforce environmental laws and protect human health and the environment, and the Temporary Policy does not excuse exceedances of pollutant limitations or give industry a license to pollute. The policy requires regulated parties to document any claims that the pandemic prevented them from conducting routine monitoring and reporting, and the EPA will consider the pandemic on a case-by-case basis when determining an appropriate response. The measures in the Temporary Policy are temporary and will be lifted as soon as normal operations can resume.
