Summary

Mitigation is required when a landowner wants to conduct activities that alter wetlands to make the production of an agricultural commodity possible, and it involves replacing lost functions, values, and acres of wetlands. The Food Security Act of 1985 introduced Wetland Conservation provisions to discourage the conversion of wetlands for agricultural purposes. Landowners who convert wetlands after December 23, 1985, will be ineligible for certain USDA benefits until the functions of the converted wetlands are mitigated or restored. Mitigation plans must be approved by the Natural Resources Conservation Service (NRCS), and landowners can restore wetlands on their own land, another person's land, or land held by a mitigation bank. Mitigation is required for activities such as filling, altering drainage, land leveling, and clearing woody vegetation, and it must be completed prior to or concurrently with planned conversions to retain USDA program eligibility.
