Summary

Combey Brice Magloire Gbadjavi, a Togolese national, claims Switzerland would violate article 3 of the Convention against Torture if he's deported to Togo, where he alleges he'd face torture. He was a member of the Union des Forces de Changement (UFC) and experienced ill-treatment by Togolese authorities in 1999. Despite attempts to flee and seek refuge, he was repeatedly arrested, beaten, and threatened. Switzerland rejected his asylum application, citing lack of credibility and the time elapsed since the alleged persecution. The Committee against Torture considered his complaint and the State party's response, ultimately adopting a decision under article 22 of the Convention.
