Summary

The EU Artificial Intelligence Act (AI Act) must be amended to protect people on the move, including migrants, asylum seekers, and refugees, from harmful uses of AI systems. The current proposal does not adequately address the harms stemming from AI use in migration contexts, such as over-surveillance, criminalization, and structural discrimination. Recommended amendments include:

1. Prohibiting unacceptable uses of AI systems in migration, such as predictive analytic systems, automated risk assessments, emotion recognition, and biometric categorization systems.
2. Expanding the list of high-risk systems used in migration to include biometric identification systems, AI systems for border monitoring and surveillance, and predictive analytic systems.
3. Ensuring the AI Act applies to all high-risk systems in migration, including those used in EU IT systems, such as Eurodac and the Schengen Information System.
4. Ensuring transparency and oversight measures apply to all AI systems used in migration, to protect the fundamental rights of every person, regardless of their migration status.
