Summary

The FDA has yet to release proposed regulations for over-the-counter (OTC) hearing aids, despite a statutory deadline of August 18, 2020. The Hearing Industries Association (HIA) has identified five areas of consumer protection that may be impacted by federal preemption of state hearing aid laws: licensure requirements, receipt requirements, return periods, promotion and advertising, and assistive technology device warranties. The HIA urges the FDA to preserve these protections at the federal level or clarify state authority to do so, to ensure strong consumer protections for the new OTC hearing aid category.
