Summary

Trade agreements worldwide are increasingly including clauses that require partners to meet certain conditions on human rights, with over 80% of agreements signed since 2013 including labour provisions and more than 40% including anti-corruption and anti-bribery clauses. The EU and India have re-launched trade talks, and to align with the importance of human rights, there will be a need for broader trade policy objectives within the context of EU-India talks. The EU's Lisbon Treaty and essential elements clause enable the incorporation of human rights standards into trade policies, and the EU has committed to including human rights in its trade agreements. The EU-India Human Rights Dialogue can provide direction for a balanced approach, and a joint memorandum of understanding on human rights could be an immediate way forward for the partners.
