Summary

The President of South Africa has assented to the Immigration Amendment Act, 2016, which amends the Immigration Act, 2002, to provide for an adequate sanction for foreigners who have overstayed in the Republic beyond the expiry date on their visa. The Act inserts new subsections into section 32 of the principal Act, disqualifying foreigners who have overstayed from qualifying for a port of entry visa, a visa, admission into the Republic, or a permanent residence permit during a prescribed period. The Director-General may waive this disqualification in exceptional circumstances. The Act also amends section 50 of the principal Act to deal with foreigners who leave the Republic after the expiry of their visa. The Act comes into operation on a date determined by the President by proclamation in the Gazette.
