Summary

Congress finds that detecting and controlling plant pests and noxious weeds is necessary to protect US agriculture, environment, and economy, and that biological control is a desirable means of doing so. The Secretary of Agriculture must facilitate exports, imports, and interstate commerce while reducing the risk of plant pest dissemination. Decisions on regulated products must be based on sound science, and the smooth movement of enterable plants and products is vital to the US economy. Unregulated movement of plant pests and noxious weeds poses an unacceptable risk, and all regulated items are considered to be in interstate or foreign commerce. The law defines various terms, including "article," "biological control organism," "enter," "export," "import," "interstate," "means of conveyance," "move," "noxious weed," "permit," "person," "plant," "plant pest," "plant product," "Secretary," "State," "systems approach," and "United States." The Secretary is authorized to regulate the movement of plant pests, and no person may import, enter, export, or move plant pests in interstate commerce without a permit and in accordance with regulations.
