Summary

The Alcona County Road Commission has the authority to control public right-of-ways, including maintaining and repairing county roads. A public road right-of-way can be abandoned through a petition by seven freeholders and following procedures outlined in MCL 224.18. Decertification of a road for highway funding purposes, as provided in Public Act 51 of 1951, does not constitute abandonment. The Commission's policy is that decertified roads remain public right-of-ways unless formally abandoned, but the Commission does not maintain or repair them and is not liable for damages occurring on such roads.
