Summary

This act authorizes a court to vacate a probation before judgment or judgment of conviction under certain circumstances, including if the act on which the conviction was based is no longer a crime, or if there is newly discovered evidence that could not have been discovered earlier and creates a substantial possibility that the result would have been different. The State must file a motion in writing, stating the grounds and describing any newly discovered evidence, and the defendant may file a response within 30 days. The court must hold a hearing if the motion satisfies the requirements and a hearing is requested, unless the court finds that the motion fails to assert grounds for relief. The court may vacate the conviction or probation before judgment and discharge the defendant, or deny the motion, and must state the reasons for its ruling on the record. The State has the burden of proof, and either party may appeal an order entered under this section.
