Summary

The Office of the Commissioner for Body Corporate and Community Management issued Practice Direction 24 to provide information on procedures and content requirements for dispute resolution applications related to debt disputes. A debt dispute is a dispute about the recovery of a debt under the Body Corporate and Community Management Act 1997 by a body corporate from an owner, and may include outstanding contributions, penalties, and costs. An adjudicator does not have jurisdiction to determine a debt dispute, and a body corporate may commence a proceeding to recover the debt through the Queensland Civil and Administrative Tribunal (QCAT) or a court. Alternatively, a body corporate or lot owner may apply for conciliation of a debt dispute. The grounds in support of an application for conciliation should include a summary of the background to the dispute, the total amount claimed, and evidence of requests to the lot owner for payment. A related dispute may be applied for conciliation or adjudication, but the Commissioner may reject or dismiss the application if satisfied that the subject matter is connected to a debt dispute before QCAT or a court.
