The Prohibition of Child Marriage Act, 2006, prohibits the solemnization of child marriages in India, except in the state of Jammu and Kashmir. A child is defined as a male under 21 or a female under 18. The Act makes child marriages voidable at the option of the contracting party who was a child at the time of marriage. The district court can grant a decree of nullity and order the return of valuables, money, and gifts. The court can also order maintenance and residence for the female contracting party and custody and maintenance for children born of the child marriage. Punishments for contracting or performing child marriages include imprisonment and fines.
