Summary

Palestinian refugees are often marginalized and invisible in discussions of rights, democracy, and social justice, with their aspirations and claims reduced to a single goal of return to their lost land and properties, overlooking their right to have rights and dignity. The classic notion of access to rights dependent on belonging to a national community is flawed, and refugees' narratives and practices call for a critical examination of nationalism and the nation-state as the sole site for self-determination. The refugee represents a bare life excluded from rights and sovereignty, and their experiences highlight the constitutive fallacies of the modern nation-state, where human rights have been used to inscribe natural life into the political juridical order, but with the fiction that being born confers membership and rights, which is not always the case.
