Summary

Congress must reauthorize Section 702 of the Foreign Intelligence Surveillance Act (FISA) to protect national security and prevent threats to democracy, as its expiration would compromise the ability to identify and mitigate risks, and impact allies who rely on the information gathered under Section 702. Despite its critical importance, recent abuses require a review of Section 702 authorities and enactment of meaningful reforms. FISA was enacted in 1978 to provide a framework for gathering foreign intelligence information, and Section 702, added in 2008, allows for the collection of foreign intelligence information from non-US persons believed to be located outside the US, whose communications travel through US-based electronic service providers. Section 702 has been described as critical and invaluable in safeguarding American lives and liberty.
