Summary

American Indian and Alaska Native (AI/AN) youth are nearly twice as likely to be petitioned to state court for status offenses, such as skipping school or violating liquor laws, and experience higher rates of detention and residential placements. They are less likely to receive probation and more likely to be placed in residential facilities. The disparities are attributed to various factors, including trauma, substance abuse, and mental health issues. Historical trauma, resulting from federal policies of assimilation and termination of tribal nations, has contributed to the erosion of tribal sovereignty and the diminishment of criminal jurisdiction, leading to violence and trauma in AI/AN communities. AI/AN youth experience higher rates of trauma, exposure to violence, and mental health issues, including PTSD, and are more likely to die from unintentional injuries and suicide. Coordination between tribal, federal, state, and local stakeholders is necessary to develop and implement effective programs that address these disparities and incorporate tribal culture and strengths-based approaches.
