The Board of County Commissioners made the following findings of fact:

The parcel of land legally described in EXHIBIT A, attached hereto and made a part hereof, is located in Section 36, Township 44 South, Range 41 East, Palm Beach County, Florida, and is a portion of Tracts 9 and 16, Block 35, Palm Beach Farms Company Plat No. 3, according to the plat thereof on file in the Office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book 2, Page 45.
The parcel of land is bounded by the following courses:
1.) N.01'27'11 E, along the east line of Section 36, a distance of 2574.92 feet to the easterly prolongation of the south line of said Tract 16;
2.) S.89'00'53"W along the south line of Tract 16 and the easterly prolongation thereof, a distance of 222.21 feet as recorded in Official Record Book 10507, Page 1304, Public Records of Palm Beach County, Florida;
3.) N.89'00'53"E along a line parallel with and 200 feet (measured perpendicular) north of the south line of Tract 16, a distance of 302.46 feet to the point of beginning;
4.) N.01'28'20"E along the west right-of-way line of U.S. 441 (State Road No. 7), a distance of 252.91 square feet (5.806 acres).
The parcel of land is generally located as shown on a vicinity sketch attached as EXHIBIT B, attached hereto and made a part hereof.
The Development Order Amendment, with conditions as adopted, is approved subject to the conditions of approval described in EXHIBIT C, attached hereto and made a part hereof.
The motion to approve the resolution was made by Commissioner Masilotti and seconded by Commissioner Aaronson, and upon being put to a vote, the vote was as follows:
Aye: Warren H. Newell, Chairman; Carol A. Roberts, Vice Chair; Karen T. Marcus; Mary McCarty; Burt Aaronson; Tony Masilotti; Addie L. Greene.
Absent: None.
The Chair thereupon declared that the resolution was duly passed and adopted on May 23, 2002.
The resolution was filed with the Clerk of the Board of County Commissioners on June 10, 2003.
