Summary

The US Department of the Interior's Solicitor has reviewed the legal basis for the 2000 regulations on hardrock mining surface management and the denial of the Glamis Imperial Corporation's plan of operations. The Solicitor rejects certain conclusions in the 1999 Opinion and supports revising the regulations. The 2000 regulations expanded the definition of "unnecessary or undue degradation" to include "substantial irreparable harm" to environmental resources, which has been challenged in court. The Solicitor concludes that this criterion should be removed and that the Federal Land Policy and Management Act (FLPMA) can prevent unnecessary degradation without it. The Solicitor also recommends rescinding the denial of the Glamis plan of operations, as the "undue impairment" provision in FLPMA requires regulatory definition before application.
