Summary

Telehealth is the use of electronic information and telecommunications technologies to support and promote long-distance clinical health care. The Notification of Enforcement Discretion regarding COVID-19 and remote telehealth communications applies to all health care providers covered by HIPAA, allowing them to provide telehealth services without fear of penalties for HIPAA violations, as long as they act in good faith. Covered entities include health care providers, such as physicians, nurses, and hospitals, but exclude health insurance companies that merely pay for telehealth services. The notification covers all patients, including those receiving Medicare and Medicaid benefits, and applies to all telehealth services, including diagnosis and treatment of COVID-19 and non-COVID-19 related conditions. It remains in effect until the Secretary of HHS declares the public health emergency no longer exists.
