Summary

Texas mandates various health benefits in fully insured major medical plans, including basic healthcare services, rehabilitation therapies, home health care, acquired brain injury, autism spectrum disorder, parity for mental health and substance use disorders, chemical dependency, serious mental illness, and crisis stabilization units. These mandates apply to individual, small group, and large employer plans, with some exceptions for self-funded plans, grandfathered plans, and Consumer Choice Plans (CCPs). Federal law, including the Affordable Care Act (ACA), also requires certain essential health benefits (EHBs) to be included in health plans sold in the individual and small group markets. The Texas Department of Insurance provides a chart outlining the applicability of these mandates to different types of plans, including CCPs, which may exclude certain state mandates but must comply with federal law.
