La procédure de prise en charge des dossiers de violence domestique implique l'expulsion de l'auteur de violences, la prise en charge des victimes et des enfants par des services d'assistance, et le traitement des dossiers au parquet.

En cas de violences domestiques, un substitut de service peut prononcer une mesure d'expulsion pour une durée initiale de 14 jours. Les services d'assistance aux victimes de violence domestique sont informés de la mesure d'expulsion et contactent les victimes pour leur offrir une assistance.

Le parquet traite les dossiers de violence domestique en fonction de la gravité des infractions constatées, des déclarations des témoins, des antécédents des auteurs et des rapports transmis par les services prenant en charge la victime et les enfants.

Les décisions du parquet peuvent inclure le classement sans suites, un avertissement simple ou avec obligation de soins, une citation à l'audience, ou l'ouverture d'une instruction pour les faits les plus graves.

Les victimes et les enfants sont automatiquement contactés en cas d'expulsion de l'auteur de violences domestiques et sont informés de leurs droits et des mesures de protection disponibles.
