Summary

The U.S. International Trade Commission has found a violation of section 337 in the investigation of certain crawler cranes and components, and has issued a limited exclusion order and a cease and desist order. The limited exclusion order prohibits the importation of certain crawler cranes and components that infringe on claims 23-26 of the '928 patent or use certain trade secrets, for a period of 10 years. The cease and desist order prohibits the domestic respondent from importing, selling, or distributing certain crawler cranes and components that use the trade secrets. The Commission has determined that the public interest factors do not preclude the issuance of these orders, and has set a bond of 100% of the entered value of the imported articles during the period of presidential review.
