The American Financial Services Association (AFSA) submitted comments on the updated proposed second amendment to the Cyber Security Requirements for Financial Services Companies (23 NYCRR 500). AFSA supports some changes but is concerned about compliance challenges. They request clarification on several sections, including the definition of "Chief Information Security Officer" (CISO), "independent audit", and "material cybersecurity issues". AFSA also suggests amendments to allow covered entities to meet requirements through certification of international cybersecurity standards and to remove or modify certain requirements, such as senior officer involvement in annual testing of incident response plans and notification of cybersecurity events at affiliates. Additionally, AFSA requests a delayed effective date of at least 12 months for all requirements to allow financial institutions adequate time to implement the new requirements.
