The Investigatory Powers (Technical Capability) Regulations 2018 set out obligations for telecommunications and postal operators to provide assistance in giving effect to interception warrants, equipment interference warrants, and warrants or authorizations for obtaining communications data under the Investigatory Powers Act 2016. The regulations include obligations to comply with warrants within a specified timeframe, ensure only authorized communications or data are disclosed, and ensure technology complies with industry standards. A targeted consultation was carried out, and amendments were made in response to feedback. The regulations apply to the whole of the United Kingdom, and the Secretary of State must consult with operators before giving a technical capability notice, taking into account technical feasibility, cost, and other effects on the operator. There is no expected impact on business, charities, voluntary bodies, or the public sector, and an Impact Assessment was not prepared as the regulations give effect to provisions in the Act, for which a full Impact Assessment was prepared.
