Deutsche Apotheker Zeitung vom 20.12.2018: Die ABDA hat drei Rechtsgutachten vorgelegt, die zum Ergebnis kommen, dass ein Versandverbot für verschreibungspflichtige Arzneimittel europa- und verfassungsrechtlich zulässig ist. Die Gutachter, darunter Prof. Jürgen Schwarze, Udo Di Fabio und Ulrich Becker, kommen zu dem Schluss, dass ein solches Verbot nicht protektionistisch, sondern zur Aufrechterhaltung des Arzneimittelversorgungssystems in Deutschland mit freiberuflichen Apothekern dient. Trotz dieser rechtlichen Argumente hat Bundesgesundheitsminister Jens Spahn angekündigt, das Rx-Versandverbot vermeiden zu wollen, da es "nicht zeitgemäß" und "nicht dauerhaft tragfähig" sei.
