Summary

Hepatitis C virus (HCV) infection rates are rising in the US, driven by injection drug use, despite the availability of curative direct-acting antiviral therapy. State policies, including Medicaid sobriety restrictions and laws criminalizing hepatitis transmission, limit access to treatment and hinder efforts to eliminate HCV. Many Medicaid programs require individuals to abstain from substance use for a specified timeframe prior to treatment initiation, despite research showing similar treatment outcomes for people who inject drugs. These restrictions persist in 26% of Medicaid programs, with 74% imposing no documented minimum time period of sobriety prior to authorizing HCV treatment. Twelve states have no laws authorizing syringe service programs, and 13 states criminalize hepatitis transmission, with most of these states also having sobriety-related restrictions to access HCV treatment in Medicaid. Stigma and discrimination are additional factors hindering HCV prevention and treatment efforts among people who use drugs.
