Summary

The US Court of Appeals for the Ninth Circuit affirmed a district court's grant of summary judgment in favor of GoDaddy.com, Inc., holding that the Anticybersquatting Consumer Protection Act (ACPA) does not provide a cause of action for contributory cybersquatting. Petroliam Nasional Berhad (Petronas) alleged that GoDaddy engaged in contributory cybersquatting by allowing a registrant to use its domain name forwarding service to direct "petronastower.net" and "petronastowers.net" to an adult website. The court found that the plain text and purpose of the ACPA do not support a cause of action for contributory cybersquatting, and that Congress did not incorporate common law trademark principles, including contributory infringement, into the ACPA.
