Summary

La Corte di giustizia dell'Unione europea ha stabilito che solo il giudice dell'Unione è competente a valutare se la legittimità della decisione della BCE che si oppone all'acquisizione di una partecipazione qualificata in Banca Mediolanum da parte di Fininvest e del sig. Berlusconi sia inficiata da eventuali vizi degli atti preparatori della Banca d'Italia. Ciò in quanto la BCE ha competenza esclusiva a decidere sull'autorizzazione dell'acquisizione e solo il giudice dell'Unione può esaminare gli eventuali vizi degli atti preparatori provenienti dall'Autorità nazionale competente (ANC) che potrebbero inficiare la validità della decisione finale. I giudici nazionali non possono esercitare un controllo di legittimità su tali atti, anche se investiti di un'azione di ottemperanza.
