Summary

Hundreds of asylum seekers who presented themselves at US ports of entry and demonstrated a credible fear of persecution are being indefinitely detained in immigration jails across the Deep South, despite a 2009 policy directing ICE to release them if they establish their identity and are not a danger or flight risk. The release rate for such asylum seekers has plummeted to single digits, with only 2 out of 130 requests granted in the New Orleans ICE Field Office's jurisdiction last year. Plaintiffs bring a class action to enjoin DHS's unwritten policy and practice of categorically denying parole to asylum seekers without individualized review, in violation of DHS's own directive and guidelines.
