AIR POWER, Inc.'s standard terms and conditions include:
1. Acceptance of offers to purchase equipment is made in writing by AIR POWER, Inc.
2. Prices are valid for 90 days from the quotation date and may be adjusted due to changes in currency exchange rates or import duties.
3. Shipment dates are estimates, and risk of loss and delivery charges are the buyer's responsibility.
4. The buyer is responsible for various tasks, including electrical field wiring, fire protection modifications, and unloading.
5. The seller provides a limited warranty, excluding damages caused by misuse, neglect, or unauthorized repairs, and disclaims other warranties, including implied warranties of merchantability and fitness for a particular purpose.
6. The buyer grants a purchase money security interest in the equipment to secure payment of the purchase price.
7. The seller is not liable for non-performance or delay caused by force majeure or failure of transportation.
8. The seller warrants good title to the equipment, free and clear of all liens and encumbrances, except for the purchase money security interest.
