Summary

The Americans for Prosperity Foundation has filed a brief as amicus curiae in support of the petitioners in the case of State of West Virginia, et al. v. Environmental Protection Agency, et al. The brief argues that the EPA has wrongly arrogated to itself Congress's exclusive power to regulate important subjects, specifically in its use of Section 111(d) to transform the nation's electricity system. The brief contends that administrative agencies are increasingly attempting to stand in Congress's shoes and that this is a violation of the separation of powers protected by the Constitution. The brief also argues that the "intelligible principle" test should be jettisoned and that common objections to enforcement of the separation of powers lack merit.
