The petition presents important issues of federal law, including the patent eligibility of process claims under Section 101. This Court's precedents, such as Diamond v. Chakrabarty and Diamond v. Diehr, establish that the governing standard for patent eligibility is found in Section 101 and its legislative history. The Federal Circuit's standard, however, is backward looking and restricts rather than promotes new innovative technologies. The Court's decisions uniformly reflect a wise openness to new types of innovations, excluding only claims to laws of nature, natural phenomena, and abstract ideas. Solutions to overly broad patent claims exist without requiring engrafting limitations on Section 101. Any changes in the broad scope of Section 101 should be left to Congress.
