Summary

Aston Villa FC and B.93 Copenhagen disputed training compensation for player M. The CAS panel ruled that a claim for training compensation doesn't need to be presented to the Dispute Resolution Chamber to be valid. The panel also stated that any violation of due process or right to be heard can be cured by an appeal to the CAS. The player's status is determined by FIFA rules, and the only relevant criterion is remuneration. The receipt of any remuneration distinguishes an amateur from a non-amateur player. The CAS also ruled that only a club with a contract with a player is obliged to offer a new contract to secure entitlement to training compensation. The CAS cannot amend the amount of training compensation if a party didn't lodge a submission or counterclaim. B.93 requested EUR 70,833 in training compensation for M., which was transferred to Aston Villa in 2003.
