Summary

Advocate General Giovanni Pitruzzella states that unlawful access to personal data by third parties leads to liability for presumed fault on the part of the controller and may give rise to non-material damage for which compensation can be awarded. To be exempt from liability, a controller must demonstrate that it is not responsible for the event giving rise to the damage. Fear of potential misuse of personal data can constitute non-material damage if it is actual and certain emotional damage, not just trouble or inconvenience. The controller must implement appropriate technical and organisational measures to ensure data protection, and the burden of proving that these measures are appropriate is on the controller.
