Summary

La Corte Suprema di Cassazione, Sez. III, con ordinanza del 24 aprile 2023, n. 10895, ha stabilito che in caso di morte del comodante, è legittimo rigettare la richiesta di restituzione dell'immobile agli eredi del comodante se il comodato è finalizzato a soddisfare un bisogno abitativo della comodataria e non è di natura precaria. La Corte ha affermato che l'accertamento della finalità del contratto di comodato deve essere effettuato considerando il complesso delle clausole contrattuali e degli elementi esterni alla convenzione negoziale, come la relazione sentimentale tra le parti e la circostanza che l'immobile fosse già utilizzato dalla comodataria al momento della stipula del contratto. In questo caso, la Corte ha confermato la decisione della Corte di Appello di Firenze, che aveva rigettato la richiesta di restituzione dell'immobile presentata dagli eredi del comodante.
