Summary

Die subreport Verlag Schawe GmbH und der Nutzer ihrer online angebotenen Dienste (Verantwortlicher) haben eine Vereinbarung zur Auftragsverarbeitung gemäß Art. 28 Abs. 3 DS-GVO getroffen. Der Auftragsverarbeiter verarbeitet personenbezogene Daten im Auftrag des Verantwortlichen, insbesondere bei der Bereitstellung von Ausschreibungsdaten, der Durchführung des Vergabeprozesses und der Unterstützung der Kommunikation zwischen Bewerbern/Bietern und Ausschreibern. Die Vereinbarung regelt die Rechte und Pflichten beider Parteien, einschließlich der Verpflichtung des Auftragsverarbeiters, die personenbezogenen Daten nur im Rahmen der getroffenen Vereinbarungen und nach Weisungen des Verantwortlichen zu verarbeiten. Der Verantwortliche ist verpflichtet, alle im Rahmen des Vertragsverhältnisses erlangten Kenntnisse von Geschäftsgeheimnissen und Datensicherheitsmaßnahmen des Auftragsverarbeiters streng vertraulich zu behandeln. Die Vereinbarung wird auf unbestimmte Zeit geschlossen und kann von beiden Parteien gekündigt werden.
