Summary

Eleven states and the District of Columbia sued the US Department of Labor, alleging its final rule interpreting the definition of "employer" in the Employee Retirement Income Security Act of 1974 (ERISA) is unlawful under the Administrative Procedure Act (APA). The rule, which allows associations of disparate employers to qualify as single ERISA plans, impacts healthcare plans under ERISA and the Patient Protection and Affordable Care Act (ACA). The court agrees with the states that the rule stretches the definition of "employer" beyond what ERISA's text and purpose will bear, and that it does violence to ERISA by extending it to cover commercial insurance transactions between unrelated parties, exceeding the statutory authority delegated by Congress.
