Summary

Custodial death is a serious crime, and independent investigation is crucial. The Supreme Court has noted that police personnel often prefer to remain silent or pervert the truth to save their colleagues. To address this, a parallel Magisterial Inquiry is conducted immediately after the incident, as per Section 176(1A) of the Code of Criminal Procedure. This inquiry is mandatory, must be carried out by a Judicial Magistrate, and is parallel to the police investigation. The Magistrate must forward the body for examination within 24 hours, and the inquiry should cover the circumstances of death, the manner and sequence of incidents leading to death, and the cause of death.
