The Bolivarian Republic of Venezuela requested to maintain the provisional stay of enforcement of an award rendered on January 29, 2016, in ICSID Case No. ARB/11/26, initiated by Tenaris SA and Talta. Venezuela submitted an application for annulment of the award on September 21, 2016, citing grounds that the tribunal exceeded its powers, seriously departed from a fundamental rule of procedure, and failed to state the reasons on which it was based. The ad hoc committee, composed of Dr. Andres Rigo Sureda, Professor Piero Bernardini, and Professor Diego P. Fernandez Arroyo, was constituted on December 27, 2016. The parties filed simultaneous submissions on the stay of enforcement and agreed to hold a hearing in March 2017. The committee extended the provisional stay until a final determination was made. Venezuela filed its first submission in support of the continuation of the stay, accompanied by annexes, while Tenaris and Talta filed their first submission in opposition, including exhibits and legal authorities.
