Summary

This thesis examines the practice of pawning clove trees in Panggul, Trenggalek, in light of Islamic law and the Indonesian Criminal Code (KUHPdt). The research found that the practice, which is based on mutual trust, allows the pawner to take control of the clove trees and keep the harvest as long as the debt is not paid. However, this practice is not in line with Islamic law, as it lacks witnesses, a time limit, and proper documentation. Additionally, the practice is not in accordance with the KUHPdt, as it does not provide evidence of the principal agreement. The research concludes that the practice of pawning clove trees in Panggul, Trenggalek, needs to be improved to comply with both Islamic law and Indonesian regulations.
