Summary

Restorative justice is a new paradigm in the criminal law field, developing broadly in many countries, including Indonesia, which has introduced the Juvenile Criminal Justice System Act (JCJSA) in 2014, utilizing diversion as a restorative justice program for juvenile delinquents. However, restorative justice has been criticized for its ability to balance public and individual interests, with proponents and opponents disagreeing on how to resolve conflicts between victims and offenders. As a Muslim-majority country, Indonesia can draw on Islamic Criminal Law (jinayat) to address this contention, as restorative justice values exist in Islamic criminal law, providing a potential bridge between public and individual interests.
