Summary

Das Bundesministerium für Justiz und Verbraucherschutz hat zwei Gesetzentwürfe zur Ratifikation des Übereinkommens über ein Einheitliches Patentgericht vorgelegt. Das politische Versprechen, mit dem neuen System vor allem kleine und mittlere Unternehmen (KMU) zu fördern, wird nicht eingehalten. Die EU-Kommission hat erklärt, dass das Kostenrisiko so erheblich sein würde, dass KMU eine Prozesskostenversicherung abschließen sollten, aber eine solche Versicherung derzeit nicht existiert. Die Kosten für die Erteilung und Durchsetzung von Patenten sind für KMU ein erhebliches Hindernis, und das neue System bietet keine ausreichenden Lösungen, um diese Kosten zu reduzieren. Die Kommission hat in der Vergangenheit wiederholt betont, dass die Kosten von Patentstreitverfahren in der EU für KMU prohibitiv sein können und dass eine Senkung dieser Kosten notwendig ist, um die Innovationstätigkeit zu fördern.
