Summary

The European Parliament adopted the "patent package" on 11/12/2012, including the "unitary patent" Regulation and the translation regime, and agreed to the Unified Patent Court System. The Regulation is based on a compromise proposal by the Cyprus Council Presidency, which was discussed in a special meeting of the Legal Affairs Committee on 19/11/2012, excluded from public access. The meeting's audio recording reveals that the compromise was considered "sub-sub-suboptimal" and a "bad solution" by one of the rapporteurs. The compromise proposal deleted Articles 6 to 8 of the initial draft Regulation and replaced them with a new Article 5a, granting the owner of a unitary patent a cease and desist claim, referencing external legal sources to define the contents and limitations of the owner's rights. The adoption of the package was followed by attempts to shift attention to its content and away from the circumstances of its adoption.
