Summary

A Nigerian national, Bright Jerry Efe, applied to the High Court of Zimbabwe for a stay of execution after being sentenced to deportation for violating the Immigration Act. Efe, the father and natural guardian of a 16-year-old Zimbabwean child, had been living in Zimbabwe on a residence permit granted on compassionate grounds after his Zimbabwean wife's death. However, his permit had expired, and he was arrested and prosecuted. The court found the application to be poorly prosecuted, with numerous procedural errors, and the judge criticized the applicant's counsel for abusing court processes by filing a constitutional application after the initial application had been withdrawn. The court ultimately found no good reason for the applicant's counsel's actions and expressed concern about the abuse of court processes.
