The Appeals Chamber of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 issued a judgement on 16 November 2012 in the case of Prosecutor v. Ante Gotovina and Mladen Markač. The judgement addressed appeals by Gotovina and Markač against their convictions for unlawful artillery attacks and existence of a joint criminal enterprise (JCE). The Appeals Chamber considered the standard of review, arguments allegedly raised only during the appeal hearing, and the lawfulness of artillery attacks on four towns. The Chamber also examined the attribution of liability via JCE and convictions under alternate forms of liability. The judgement included separate and dissenting opinions from Judges Theodor Meron and Carmel Agius. Ultimately, the Appeals Chamber reversed the convictions of Gotovina and Markač, acquitting them of all charges.
