Rule 3.4(e) of the New York Rules of Professional Conduct prohibits lawyers from threatening criminal charges solely to obtain an advantage in a civil matter, but does not apply to threats of ancillary non-criminal proceedings, such as reporting an adverse party's misconduct to an administrative or regulatory agency. However, such threats may still violate other rules, including Rule 8.4(b) if they constitute extortion, Rule 8.4(d) if they are prejudicial to the administration of justice, or Rule 4.1 if they are made without a sufficient basis in fact and law.
