Summary

2918 sayılı Karayolları Trafik Kanunu gereğince, işleten ve teşebbüs sahibinin sorumluluğu, aracın işletilmesinden doğmuşsa, kusursuz sorumluluktur. Kusursuz sorumluluğun türü ise tehlike sorumluluğudur. Bu sorumluluk türünde sorumluluk şartları, sorumlu aleyhine ağırlaştırılmıştır. Sorumluluğun temeli işletme tehlikesi ve türü ise tehlike esasına dayalı işletme sorumluluğudur. Tehlike sorumluluğuna göre, sorumlu olanın, kusursuz olduğunu veya gerekli dikkat ve özeni gösterdiğini ispat ederek sorumluluktan kurtulması mümkün değildir. Sorumluluğu gerektiren her durumda, tehlike esasının uygulanması, hakaniyetle bağdaşmayacağından kanun koyucu tarafından bazı sorumluluk hallarında farklı esaslar benimsenmiştir. Sorumluluğun genel hükümlere tabi olduğu hallere göre, sorumluluğun varlığı kusura bağlıdır. Kusursuz olduğunu ispat eden işleten ve teşebbüs sahibi, sorumluluktan kurtulabilir. İşleten ve teşebbüs sahibinin sorumluluğu söz konusu olsa dahi, haksız fiile ilişkin indirim sebeplerinin varlığı halinde, hükmedilecek tazminattan indirim yapılabilmesi de mümkündür.
