Summary

The US environmental justice movement, which aims for fair treatment and equal protection from environmental hazards for all people, has largely overlooked the plight of inmates in toxic prisons. However, the movement is starting to address this issue. Prisons disproportionately impact minority populations, who are already overrepresented in the incarcerated population. For example, in Indiana, blacks make up 34% of the incarcerated population despite only making up 9% of the total population. The Environmental Protection Agency's (EPA) addition of a prison layer to its Environmental Justice and Screening Tool is a step towards analyzing prisons from an environmental justice perspective. Toxic prisons, such as SCI Fayette in Pennsylvania, expose inmates to hazardous materials like coal ash, which contains heavy metals and minerals that can cause cancer, nervous system damage, and other health problems. The note explores four examples of toxic prisons and argues that they are unconstitutional and should not be in operation.
