Der Bundesrat will mit einem Gesetzentwurf das Problem des "Gaffens" bei Unglücksfällen bekämpfen, indem er das Behindern von Rettungskräften unter Strafe stellt, ohne dass es dabei zur Anwendung von Gewalt oder Drohungen kommen muss. Der Entwurf sieht auch eine Änderung des § 201a StGB vor, um das Fotografieren und Filmen von Unfallopfern unter Strafe zu stellen. Die Notwendigkeit eines solchen Gesetzes ist jedoch fraglich, da die derzeitige Gesetzeslage bereits Möglichkeiten bietet, gegen Gaffer vorzugehen, wie z.B. § 114 Abs. 3 StGB, Körperverletzungsdelikte, Tötungsdelikte und Nötigung. Es bleibt abzuwarten, ob der Gesetzentwurf tatsächlich eine Verbesserung bringt oder ob er neue Probleme mit sich bringt.
